Divorce

A Divorce or Legal Separation is a very rough process on both parties and the children, if any. The spouse who initiates the filing of a divorce is named the Petitioner and the spouse who responds is named the Respondent. The most common grounds where the Court will grant a Petition for Dissolution of Marriage or Petition for Legal Separation is “Irreconcilable Differences which have caused the irremediable breakdown of the marriage”. An irreconcilable difference means that either party has formed the opinion that their relationship has broken down to such an extent that no form of counseling or therapy will help the parties reconcile. Once a Petitioner files for Divorce and certain legal requirements are satisfied, the court has authority to make orders regarding child support, spousal support, custody, visitation, and property and debt division.
